Service Description
Utah Pest Control provides residential and commercial pest management services throughout the State of Utah. Our services include, but are not limited to, inspection, identification, treatment, and monitoring of pests such as insects, rodents, spiders, and other common pests native to or present in Utah. Treatments may involve the application of EPA-registered pesticides, baits, traps, exclusion methods, and integrated pest management techniques tailored to specific property conditions and pest pressures.
Service frequency, scope, and methodology are determined at the discretion of Utah Pest Control based on professional assessment, seasonal conditions, and applicable regulatory requirements. All services are performed by licensed technicians in accordance with Utah Department of Agriculture and Food (UDAF) regulations and federal guidelines governing pesticide application. Customers will be provided with service documentation, including treatment dates, products used, and any post-treatment instructions, either in physical or electronic format.
Additional services, including specialized treatments for termites, bed bugs, wildlife, or other complex infestations, may require separate agreements and pricing. We reserve the right to decline service for properties that present safety hazards, are inaccessible, or fall outside our operational service area.
No Guarantee or Warranty
Utah Pest Control makes no express or implied guarantees regarding the complete eradication of pests or prevention of future infestations. Pest biology, environmental conditions, neighboring properties, and customer compliance with recommended practices all influence treatment outcomes. Results may vary, and no warranty is provided that treated premises will remain pest-free for any specific duration.
Re-treatment services, when offered, are contingent upon customer adherence to all preparation requirements, sanitation protocols, and structural maintenance recommendations. Utah Pest Control does not warrant against damage caused by pests before, during, or after treatment, nor does it guarantee the absence of property damage resulting from pest activity. Any re-treatment or follow-up services are provided at the sole discretion of Utah Pest Control and may incur additional fees unless explicitly included in a written service agreement.
User Responsibilities
Customers are responsible for providing accurate information regarding property conditions, prior pest control treatments, known allergies or sensitivities of occupants, and presence of pets or vulnerable individuals. Failure to disclose such information may compromise treatment efficacy and safety.
Customers must prepare the property as instructed prior to service, including but not limited to securing food and utensils, removing or covering items in treatment areas, ensuring access to crawl spaces, attics, and exterior perimeters, and keeping pets and children away from treated areas for the specified re-entry interval. Customers are responsible for maintaining proper sanitation, eliminating conducive conditions such as standing water and accessible food sources, and implementing structural repairs to prevent pest entry.
Payment is due according to the terms specified in the service agreement or invoice. Late payments may result in service suspension and collection activities. Customers must notify Utah Pest Control within forty-eight hours of any adverse reactions, suspected treatment failures, or property damage concerns.
Limitation of Liability
To the maximum extent permitted by law, Utah Pest Control's total liability for any claim arising from or relating to our services shall not exceed the total amount paid by the customer for the specific service giving rise to the claim. Utah Pest Control shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, personal injury beyond that caused by our gross negligence, property damage not directly resulting from our willful misconduct, or emotional distress.
Utah Pest Control is not liable for adverse reactions in individuals with undisclosed chemical sensitivities, pre-existing respiratory conditions, or allergies. We are not responsible for damage to personal property that was not removed from treatment areas as instructed, nor for the death of plants, aquarium life, or pets due to customer failure to follow pre-service or post-service instructions. This limitation of liability applies regardless of the legal theory under which any claim is brought.
Intellectual Property
All content, materials, trademarks, service marks, logos, trade names, and proprietary information displayed on Utah Pest Control's website, marketing materials, service documentation, and other communications are the exclusive property of Utah Pest Control or its licensors. Customers and website visitors are granted no license or right to use, reproduce, distribute, modify, or create derivative works from any such intellectual property without prior written consent.
Customer testimonials, reviews, or photographs submitted to Utah Pest Control may be used for marketing purposes with appropriate attribution, unless the customer explicitly opts out in writing. Technical information, treatment protocols, and proprietary methodologies developed or employed by Utah Pest Control constitute trade secrets and confidential business information protected under applicable law.
Governing Law
These Terms of Service and any disputes arising from or relating to services provided by Utah Pest Control shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles. Any legal action, proceeding, or dispute resolution shall be brought exclusively in the state or federal courts located in Salt Lake County, Utah.
Both parties agree to submit to the personal jurisdiction of such courts and waive any objection to venue in Salt Lake County. In the event of any conflict between these terms and Utah state law, the applicable provisions of Utah law shall prevail to the minimum extent necessary.
Changes to Terms
Utah Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without prior individual notice. Changes become effective upon posting to our website with an updated effective date. Continued use of our services following any modifications constitutes acceptance of the revised terms.
Material changes affecting pricing, liability limitations, or dispute resolution procedures will be communicated to active customers via email or written notice at least thirty days prior to effectiveness, where practicable. Customers are encouraged to review these terms periodically. The version in effect at the time of service performance shall govern any dispute regarding that service.
